These Terms of Service ("Terms") govern your use of the website at myprojectsinc.com (the "Site"), operated by My Projects Inc, a California corporation ("My Projects," "we," or "us"). By using the Site, you agree to these Terms.
If you engage My Projects for event planning or design services, a separate Service Agreement governs that engagement. These Terms apply only to your use of the Site.
1. Acceptance
By accessing or using the Site, you confirm that you are at least 18 years old and that you accept these Terms. If you do not accept them, please do not use the Site.
2. Eligibility
The Site is intended for visitors located in the United States. If you access it from elsewhere, you do so on your own initiative and are responsible for compliance with local laws.
3. Acceptable Use
You agree to use the Site only for lawful purposes. You will not:
- Use the Site in a way that could disable, overburden, or impair it
- Attempt to gain unauthorized access to any portion of the Site or its systems
- Use any automated means (scrapers, bots, harvesters) to access the Site, except for well-behaved search engine crawlers
- Reverse engineer, decompile, or attempt to extract source code
- Use the Site to transmit any material that is unlawful, defamatory, infringing, or harmful
- Interfere with another user's use of the Site
- Submit false information through any form
We may suspend or terminate your access if we reasonably believe you have violated these Terms.
4. Intellectual Property
All content on the Site — including text, photographs, illustrations, logos, designs, page layouts, and source code — is owned by My Projects or its licensors and protected by United States and international copyright, trademark, and other intellectual property laws.
You may view and print pages for your personal, non-commercial use. You may not reproduce, redistribute, publish, modify, or create derivative works from any content without our prior written consent.
The marks "My Projects," "My Projects Inc," and any associated logos or designs are our trademarks. You may not use them without our permission.
5. Submissions
If you send us inquiries, photographs, ideas, or other materials through the Site, you grant us a non-exclusive, royalty-free license to use those materials for the purpose of responding to your inquiry and providing services to you.
We do not claim ownership of your submissions, and we treat them according to our Privacy Policy.
6. Third-Party Links
The Site may contain links to third-party websites (Instagram, vendor partners, mapping services). We are not responsible for the content, accuracy, or practices of those sites. Your use of any linked site is at your own risk and subject to that site's terms.
7. No Warranties
The Site is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. Information on the Site is provided for general informational purposes and is not a substitute for professional advice.
Pricing and package details shown on the Site are estimates. Final pricing and scope are confirmed only in your individual Service Agreement.
8. Limitation of Liability
To the fullest extent permitted by law, My Projects and its officers, directors, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site, including loss of profits, data, goodwill, or other intangible losses.
Our total liability arising from these Terms or your use of the Site is limited to one hundred dollars (US$100).
Some jurisdictions do not allow these limitations; in those places, our liability is limited to the maximum extent permitted by law.
9. Indemnification
You agree to indemnify and hold harmless My Projects and its officers, directors, employees, and contractors from any claim, loss, or expense (including reasonable attorneys' fees) arising from your breach of these Terms or your misuse of the Site.
10. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws provisions.
11. Dispute Resolution
Before filing any claim, you agree to attempt to resolve disputes informally by contacting us at m.projectsinc@gmail.com. If we cannot resolve the dispute within sixty (60) days, either party may proceed under the following terms.
Any dispute arising from these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of those courts. The prevailing party may recover reasonable attorneys' fees and costs.
This section does not affect the dispute resolution process in your Service Agreement, which governs disputes about event services.
12. Changes to These Terms
We may revise these Terms from time to time. When we do, we will update the "Last updated" date above. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
13. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force. The unenforceable provision will be replaced with an enforceable one that most closely reflects the original intent.
14. Entire Agreement
These Terms, together with our Privacy Policy and any Service Agreement you sign with us, constitute the entire agreement between you and My Projects regarding your use of the Site.
